1. Agreement to Terms

These Terms and Conditions ("Agreement") create a legally binding agreement between you ("Lessee," "you," or "your") and Miami Flight Services LLC ("Company," "we," "us," or "our"). By using the services provided by the Company through the website aviationraft.com (the "Website"), you agree to comply with and be bound by these terms.

2. Rental of Survival Equipment

2.1. Rental Equipment Overview

The Company offers the rental of survival equipment, which includes life rafts, life jackets, ELTs, and related items ("Rental Equipment"). The Rental Equipment depicted on the Website is for illustrative purposes and may not accurately represent the actual rental product.

2.2. Rental Period and Charges

All rental periods are calculated from the moment the Rental Equipment leaves the Company's facility until it is returned to the same facility.

2.3. Lessee Responsibilities

You acknowledge and accept responsibility for any loss, theft, or damage to the Rental Equipment during the rental period.

2.4. Verification of Equipment

It is your sole responsibility to verify that the rented equipment is current and suitable for your intended use prior to its usage.

3. Credit Card Authorization and Charges

3.1. Payment Authorization

By providing a valid credit card, you authorize the Company to securely store your credit card information.

3.2. Additional Charges

The Company retains the right to charge your credit card for extra rental days, shipping costs, lost, stolen, or damaged equipment, and other applicable charges as outlined in this Agreement.

3.3. Automatic Billing

You consent to the Company using your provided credit card for any rental-related expenses without requiring further authorization.

4. Lien and Unpaid Charges

4.1. Lien for Unpaid Charges

In cases of unpaid charges related to Rental Equipment, the Company reserves the right to place a lien against the aircraft or boat where the equipment was utilized.

5. Tracking of Rental Equipment

5.1. Equipment Tracking

The Company may employ various technologies, including but not limited to GPS tracking, to monitor the location and usage of Rental Equipment, whether during the rental period or not. This tracking is intended to ensure effective management and security of our equipment.

6. Inflated Life Raft

6.1. Inflation Clause

You agree that in the event a life raft is intentionally or unintentionally inflated, you are responsible for compensating the Company for the full value of the life raft.

7. Disclaimer of Warranty

7.1. Equipment Warranty

The Company does not provide any explicit or implicit warranties concerning the Rental Equipment's suitability for a specific purpose or its condition.

8. Limitation of Liability

8.1. Liability Restrictions

The Company is not liable for direct, indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use the Rental Equipment.

9. Indemnification

9.1. Lessee's Responsibility

You agree to indemnify and hold the Company harmless from claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Rental Equipment.

10. Termination

10.1. Termination Rights

The Company reserves the right to terminate or suspend any rental agreement in the event of a Lessee's violation of these Terms and Conditions.

11. Governing Law

11.1. Applicable Law

This Agreement is subject to and interpreted in accordance with the laws of the state of Florida, without regard to its conflict of law principles.

12. Changes to Terms and Conditions

12.1. Modification Notice

The Company retains the right to modify or update these Terms and Conditions at any time. Your continued use of the Website and rental services signifies your acceptance of any changes.
